Lawyer Evaluation in Chinese Courtroom: A Social-Semiotic Perspective

This book focuses on the speech style of lawyer talk in contemporary Chinese courtrooms. The topic is intriguing to readers who may wonder how lawyers compete with their opposing counterparts in an adversarial trial system in China. The legal tradition in Confucianism, which advocates harmony in interpersonal relationships, has historically guided the practice of law in China. The book analyses how lawyers manage to compete in this system. Applying the social semiotic view of language in the Hallidayian sense, specifically systemic functional linguistics and its appraisal theory, this study interprets the subjectivity of legal language by lawyers. The speech style in legal argument presentation is described as 'rational'. The exploration of the rational speech style of lawyers is a theoretical and discursive topic. It draws upon Habermasian philosophy of intersubjectivity in legal argumentation and considers the cultural and legal contexts of China as contextual constraints. The keyconstruct of lawyer evaluation is fully captured in this discussion. As a linguistic phenomenon and unit of analysis, discourse can be examined both within local clauses and in larger stretches of talk beyond clauses. Additionally, it serves as an effective means for constructing a rational speech style for lawyers. Most importantly, discourse is a discursive act that negotiates legal arguments in the dynamic speech exchanges of a court trial, which is embedded in a wider social and cultural context. The book showcases instances of lawyer talk in well-documented trials in China and offers a good opportunity for readers to gain a general understanding of courtroom discourse in the Chinese context. It introduces readers with special interests in legal language and the law to the solidarity dimension of legal language and arguments, an alternative to the confrontational or hostile lawyer talk in trials in countries with a common-law system. The analysis presented is refined and the language used is clear, concise, and objective.

Mental Fatigue Assessment in Demanding Marine Operations

This book investigates how human mental fatigue (MF) can be objectively measured during demanding maritime operations. The maritime domain is characterized by demanding operations. These operations can be especially complex and dangerous when they require coordination between different maritime vessels and several maritime operators. The best approach to quantify MF is through the use of physiological sensors including electroencephalogram (EEG), electrocardiogram, electromyogram, temperature sensor, and eye tracker can be applied, individually or in conjunction, in order to collect relevant data that can be mapped to an MF scale. More than simpler sensor fusion, this book bridges the gap between relevant sensor data and a quantifiable MF level using both data-driven and model-based approaches. Data-driven part investigates the use of different NNs combined for the MF assessment (MFA) task. Among the different architectures tested, convolutional neural networks (CNN) showed the best performance when dealing with multiple physiological data channels. Optimization was used to improve the performance of CNN in the cross-subject MFA task. Testing different combinations of physiological sensors indicated a setup consisting of EEG sensor only was the best option, due to the trade-off between assessment precision and sensor framework complexity. These two factors are of great importance when considering an MFA system that could be implemented in real-life scenarios. The model-based discussion applies the current knowledge about the use of EEG data to characterize MF to develop an MF approach to quantify the progression of MF in maritime operators. In the research presented in this book, realistic vessel simulators were used as a platform for experimenting with different operational scenarios and sensor setups.

Die Wahrnehmung der südafrikanischen Eliten gegenüber China

In den vergangenen 20 Jahren mit den intensiven chinesischen Aktivitäten auf dem afrikanischen Kontinent sind die Beziehungen zwischen China und Afrika zu einem wichtigen Forschungsgegenstand in der internationalen Politikwissenschaft geworden. Der Großteil dieser Abhandlungen analysiert das Thema aus der Perspektive Chinas, dagegen sind kaum systematische Untersuchungen aus dem Blickwinkel der Afrikaner zu finden. In diesem Buch werden die Wahrnehmungen der südafrikanischen Eliten in Bezug auf China in den Jahren von 2006 bis 2016 systematisch untersucht. Die Wahrnehmungen konzentrierten sich dabei auf Chinas Auswirkungen auf Südafrika bezogen auf vier Aspekte: Chinas wirtschaftliche Aktivitäten, die chinesische globale politische Strategie, das chinesische Entwicklungsmodell sowie Chinas Soft Power. The aesthetics of law deals with the relationship between law and beauty by searching for aesthetic values in the law itself (an internal perspective), by finding material related to law in art and culture (an external perspective), and, lastly, by demonstrating the impact of legal norms on what can be broadly understood as beauty (law as a tool of aestheticization). Regarding all these phenomena, the aesthetics of law ultimately allows us to see the law more clearly and more profoundly. What is more, the law does not function, nor has it ever functioned, separately from its means of expression, which are incontrovertibly subject to aesthetic interpretation. If we think about law in this way, perceiving not only the message, but also the manner in which it is conveyed, the whole set of means and tools used, the perfection and beauty of the form, then we will see art in it. After all, the widely known and still applicable ancient maxim ius est ars boni et aequi equates law and art. This alone should be an argument for aesthetic reflection on the law, a field of endeavour that should never have been abandoned. The book’s twenty-three chapters, written by scholars from various countries and three continents, are thematically diverse. In them we present the manifestations of the aesthetics of law from an external perspective. If we accept a definition of the concept of law that is as broad as possible, not only as a synonym of a certain formalized normative system, but also including the process of its creation (legislation), its application and interpretation (jurisprudence), and even teaching on and research into it (doctrine), we can identify a wealth of aesthetic references in the law. A broadly understood aesthetics of law, approached solely from an external perspective, covers such disciplines as law and literature, the aesthetics of legal rhetoric, the trial as performance, the aesthetics ofcourthouse architecture, law in the fine arts, law in film, law and music, pictorial law, symbols of the law and legal symbols, symbols of the state and power, legal archaeology etc. The field of research is, therefore, wide. In addition to topics traditionally and obviously associated with the aesthetics of law, such as law and literature, law in the fine arts, and court rhetoric, there are chapters on e.g. legal ethics and trademarks. All authors share the belief that beauty in law is important, even when it is hidden in a caricature. Further, they argue for restoring the aesthetics of law to its proper place in philosophical and legal discourse, as doing so would yield a host of benefits for the addressees of law.
