The reform offers a popular and compelling narrative based on the meritocracy and rugged individualism myths that are supposed to define American idealism. This volume will refute this ideology by proposing Social Context Reform, a term coined by Paul Thomas which argues for educational change within a larger plan to reform social inequity—such as access to health care, food, higher employment, better wages and job security. Despite decades of attempts and the best intentions of its members, the United States Supreme Court has failed to develop a coherent jurisprudence regarding the state’s proper relationship to the individual. Without some objective standard upon which to ground jurisprudence, decisions have moved along a spectrum between freedom and authority and back again, affecting issues as diverse as individual contractual liberties and the right to privacy. Social Contract Theory in American Jurisprudence seeks to reintroduce the lessons of modern political philosophy to offer a solution for this variable application of legal principle and to lay the groundwork for a jurisprudence consistent in both theory and practice. Thomas R. Pope’s argument examines two exemplary court cases, Lochner v. New York and West Coast Hotel v. Parrish, and demonstrates how the results of these cases failed to achieve the necessary balance of liberty and the public good because they considered the matter in terms of a dichotomy. Pope explores our constitution’s roots in social contract theory, looking particularly to the ideas of Thomas Hobbes for a jurisprudence that is consistent with the language and tradition of the Constitution, and that is also more effectually viable than existing alternatives. Social Contracts and Economic Markets

The thesis of this book is that people enter into social contracts because they are different from one another and have incentives to cooperate. In economic life, people have identical interests—namely, their own se- interests—so they have an incentive to compete. The social worlds that we create, or map, and those that are already mapped for us are increasingly complex, and thus the tracking of rationality is not so straightforward, although it is everywhere evident. In a sense, this book grew out of two questions: Why hasn't the United States had a second revolution? Or is the revolution yet to come? Many have discussed the current crises that confront contemporary society, such as great economic inequalities, poverty, the declining quality of jobs, the growing power of corporate elites, and racial antago­ nisms. I attempt to understand these problems in terms of the radical restructuring of social life by economic and spatial forces. My specula­ tive thesis is that social organizations must reinforce social contracts and nurture the opportunities for them to be forged. However, contemporary organizations, particularly economic ones, have internalized the princi­ ples of economic markets, thereby inducing competition and easing out cooperation. In defining social contracts, I draw from Rousseau and also from Marx and his analysis of use value. One hopes that new organiza­ tional forms based on principles of democracy and community will evolve. In a diverse, multicultural society, this requires great mutual understanding and cooperation and the recognition of differences.

The book further concludes that social control and deviance are intricately interrelated. While social control defines what is deviance, the latter has important implications for the former: repeated occurrence of deviance prompts agencies of social control to redefine and gradually normalize deviance.

This book grew out of the conviction that the preparation and management of large-scale technological projects can be substantially improved. We have witnessed the often unhappy course of societal and political decision making concerning projects such as hazardous chemical installations, novel types of electric power plant or storage sites for solid wastes. This has led us to believe that probabilistic risk analysis, technical reliability analysis and environm,ental impact analysis are necessary but insufficient for making acceptable, and justifiable, social decisions about such projects. There is more to socio-technical decision making than applying acceptance rules based on neglige ably low accident probabilities or on maximum credible accidents. Consideration must also be given to psychological, social and political issues and methods of decision making. Our conviction initially gave rise to an international experts' workshop titled 'Social decision methodology for technological projects' (SDMTP) and held in May 1986 at the University of Groningen, the Netherlands, at a time when Cvetkovich spent a sabbatical there. The work­ shop - aimed at surveying the issues and listing the methods to address them - was the first part of an effort whose second part was directed at the production of this volume. Plans called for the book to deal systematically with the main problems of socio-technical decision making; it was to list a number of useful approaches and methods; and it was to present a number of integrative conclusions and recommendations for both policy makers and methodologists.
