Secession in the Formal-Legalist Paradigm: Implications for Contemporary Revolutionary and Popular Movements in the Age of Neoliberal Globalization

This book explores how formal-legalism, as the dominant paradigm of explanation, has sought to explain the phenomenon of secessionism among its practitioners as a problem for the modern state. This study bears how these practitioners have, over time, described, defined, and proposed to solve secessionism and related political problems within the logic of their paradigm. In the process, the book reconstructs the formalist worldview and the practitioners’ fundamental presuppositions which, to them, render comprehensible and meaningful the occurrence of events, like secession, as well as means of dealing with it. More significantly, the book exposes a debilitating flaw of formal-legalist paradigm as it fails to account for other principles of mobilization in political and social life that defy formal-legal rules such as those based on race, ethnicity, language, culture, and material factors. Narrow adherence to textual sources and the literal approach, have led formal-legalists to miss, willfully ignore, or endorse the paradigm's strategic association with state power, evolving since the dawn of the Enlightenment. Formal-legalism has lent itself amenable to the interests of the state and to the variable construction of the meaning of the law devoid of original spirit and universality but conforming with the specific interests of the state or, for that matter, the prevailing American empire, both spatially and temporally. Accounting for this anomaly, the historical materialist perspective is considered, with appropriate historical and contemporary illustrations, as a relevant explanatory alternative to the now-obsolescent formal-legalist paradigm. With the assumption that, indeed, economic and material considerations such as those demanded by the dominant class elements within the state underlie the rationale for the state, formal-legalism has evolved from one that initially provided a presumed objective view of society to one that has subjectively become an essential part of the cultural suprastructure that allows these elements to command the state as a principal tool for labor- and value-extraction during what is popularly known as contemporary neoliberal globalization.

A Philosophical Critique of Thought

This book is mainly concerned with elaborating an account of the unique theoretical essence and activities of philosophy. What manner of civilization should modern humans forge? On what developmental path should a nation embark? What lifestyle should each individual choose? These are the most fundamental issues of our time. Profoundly implicit in the choices outlined above is a deeper question: What are the criteria of choice? An examination of these criteria is a reflection on the premises constituting thought, or a critique of the premises underlying thought. Using a “critique of the premises underlying thought” as the basic idea and hermeneutic principle in philosophy will open a wider theoretical space for contemporary philosophy so as to avoid the predicament of being “pseudo-scientific” or “pseudo-artistic.” It will also present contemporary philosophy with a realistic path of development for the task of reflecting on the criteria of choice. This book seeks to formulate concrete philosophical arguments for a critique of the basic beliefs, logic, modes, concepts, and philosophical ideas which constitute thought, with the aim of demonstrating the vigorous self-critique and inexhaustible theoretical space found in philosophical development. This book provides a new principle of interpretation for understanding philosophy and, in turn, uses this principle to develop a critique of the premises underlying thought, thereby furthering the contemporary development of philosophy. This book encompasses a critique of the premises underlying thought, which mainly includes the basic beliefs, logic, modes, concepts, and philosophical ideas constituting thought. Such a critique should comprise five aspects: First, the basic beliefs constituting thought propose a critique of the identity of thought and being; second, the basic logic constituting thought refers to a critique of the formal, intensional, and practical logic of thought; third, the basic modes constituting thought denote a critique of the basic modes by which humans comprehend the world, including commonsense, religion, art, and science; fourth, the basic concepts constituting thought entail a critique centering on being, the world, history, truth, value, and other basic concepts; and finally, the philosophical ideas constituting thought indicate a critique of philosophy itself. A critique aligned on these five aspects will provide a general philosophical overview of the premise critique of thought.

National Conceptualisations of the Body Politic: Cultural Experience and Political Imagination (Cultural Linguistics)

This book presents the results of a large-scale experiment into interpretations of the metaphor “the Nation as a Body” among 1,800+ respondents from 30 linguistic and cultural backgrounds. In this first account of an empirical study of cross-cultural global metaphor interpretation of that scale, Musolff confirms that the meanings of metaphors are complex, culturally mediated and may differ for senders and recipients. The book provides a historical and cultural map of the traditions underlying differences in how the nation as a body – or, “the body politic” – is understood. Musolff challenges the hypotheses of the universality of “the nation” as a predominantly male-gendered and hierarchically organized concept and, in so doing, puts into question some of the key presuppositions of traditional historical and cognitive approaches to metaphor. ​This book discusses the influence of creative work on human life, and the role it has played in shaping human civilization since antiquity. To do so, it analyzes the history of thought on creative work from three civilizations: Greek, Indian, and Chinese, as well as contemporary neurological studies on consciousness. According to the classical Greeks, humans are instinctively predisposed to use creative work to gain truth, wisdom and happiness; the Indians consider that Dharma (duty, morality, etc.) can be achieved only through work (karma); and for the Chinese, creative work is needed to attain the supreme wisdom (Dao). Modern studies on consciousness show that our brain creates a personal self-model (ego tunnel) when we learn things creatively, and developing such skills provides lifelong protection for the brain. In the 21st century, human involvement in creative work is declining as we use mechanized systems to gain more and more profit, but the wealth falls into the hands of the few superrich: the Plutonomy. As creative work is taken over by AI systems, human work is reduced to operating those machines, and this in turn leads to an exponential growth in the number of part-time workers (Precariat). The declining value of human life today is a consequence of this change in society. Further, reducing creative work means we have no way to distribute wealth, nor do we have any means to address problems like the lack of enthusiasm in the young; the health crisis due to lack of physical activity; or the environmental crisis due to the high demand for energy to run mechanized systems. This book explores these issues.
