Ordoliberalism is a theoretical and cultural tradition of significant societal and political impact in post-war Germany. For a long time the theory was only known outside Germany by a handful of experts, but ordoliberalism has now moved centre stage after the advent of the financial crisis, and has become widely perceived as the ideational source of Germany's crisis politics.In this collection, the contributors engage in a multi-faceted exploration of the conceptual history of ordoliberalism, the premises of its founding fathers in law and economics, its religious underpinnings, the debates over its theoretical assumptions and political commitments, and its formative vision of societal ordering based upon a synthesis of economic theories and legal concepts. The renewal of that vision through the ordoliberal conceptualisation of the European integration project, the challenges of the current European crisis, and the divergent perceptions of ordoliberalism within Germany and by its northern and southern EU neighbours, are a common concern of all these endeavours. Anders als beispiels­ weise bei Medikamenten, die theoretisch in beliebiger Menge hergestellt werden konnen, hangt die Versorgungslage der Bevolkerung mit Trans­ plantaten vom vergleichsweise "une1astischen" Angebot an Organspendern ab: Jede Organtransplantation setzt notwendigerweise voraus, daB das transplantierte Organ zuvor aus dem Korper eines (lebenden oder verstor­ benen) Organspenders entnommen wird. Von dieser "Organgewinnung" handelt dieses Buch. Auch aus dem Blickwinke1 des Juristen konzentrierte sich das Interesse an der Transplantationsmedizin seit jeher iiberwiegend auf die Organge­ winnung und weniger auf die Organiibertragung. Durch Jahrzehnte hin­ durch war die Frage nach den rechtlichen Voraussetzungen einer Organ­ entnahme Gegenstand iiberaus kontroversieller Diskussionen. Mit einer Novelle zum Krankenanstaltengesetz (§§ 62a bis c) hat der osterreichische Gesetzgeber im Jahre 1982 in diesem umstrittenen Bereich des Gesund­ heitsrechts eine klare rechtspolitische Entscheidung getroffen und die (in der Praxis vorherrschende) Organentnahme aus Leichen ausdriicklich gerege1t. Damit sind manche der alten Streitfragen - insbesondere nach dem Zustimmungsrecht der AngehOrigen -gegenstandslos geworden; auf der anderen Seite entstand~n neue Auslegungsprobleme, die ihre Ursache in der Unbestimmtheit und Knappheit der neugeschaffenen Bestimmungen haben. Zu ihrer LOsung will die vorliegende Untersuchung einen Beitrag leisten. Beabsichtigt war, die wichtigsten rechtlichen Aspekte der Organge­ winnung aus der Sicht des Krankenanstaltenrechts erstmals umfassend und systematisch darzustellen; daB es in diesem Zusammenhang freilich nicht moglichwar, aile denkbaren Rechtsfragen erschopfend und abschlieBend zu erortern, liegt schon in der Neuheit des Themas begriindet.

Ebenso wie seine Vorgänger liefert auch das 8. GI-Fachgespräch ein getreues Spiegelbild der Probleme, die sich in den jeweiligen Zeiträumen in den Rechenzentren ergeben haben. Zum Zeitpunkt des 8. Fachgesprächs bestimmen Themenkreise wie dezentrale Datenverarbeitung, ihre Beherrschbarkeit und ihre Grenzen, aber auch der Ausblick auf neue Techniken und Entwicklungstendenzen, Sicherheitsaspekte und Hochgeschwindigkeitsnetze die Diskussion. Die zunehmende Betrachtung der Rechenzentren unter Kosten-Nutzen-Gesichtspunkten führte zum Themenkreis "Kapazitätsplanung und -management". Traditionsgemäß wird auch dieses Fachgespräch von einer Hochschule, der Heinrich-Heine-Universität Düsseldorf, ausgerichtet. Der Trend der Hochschulen - und damit auch ihrer Rechenzentren - geht hin zum Wissenstransfer und Technologieaustausch mit Unternehmen der Wirtschaft und Industrie. Berücksichtigt wird dies im Themenkreis "Kooperation Wirtschaft/Hochschule", in dem über die Erfahrungen in der Zusammenarbeit zwischen Wirtschaft und Wissenschaft bei der Entwicklung komplexer Softwaresysteme berichtet wird.
