It is many years since Landin, Burge and others showed us how to apply higher order techniques and thus laid some foundations for modern functional programming. The advantage of higher order descriptions - that they can be very succinct and clear - has been percolating through ever since. Current research topics range from the design, implementation and use of higher order proof assistants and theorem provers, through program specification and verification, and programming language design, to its applications in hardware description and verification. The papers in this book represent the presentations made at a workshop held at Banff, Canada, September 10-14 1990 and organised by the Computer Science Department of the University of Calgary. The workshop gathered together researchers interested in applying higher order techniques to a range of problems. The workshop format had a few (but fairly long) presentations per day. This left ample time for healthy discussion and argument, many of which continued on into the small hours. With so much to choose from, the program had to be selective. This year's workshop was divided into five parts: 1. Expressing and reasoning about concurrency: Warren Burton and Ken Jackson, John Hughes, and Faron Moller. 2. Reasoning about synchronous circuits: Geraint Jones and Mary Sheeran (with a bonus on the fast Fourier transform from Geraint). 3. Reasoning about asynchronous circuits: Albert Camilleri, Jo Ebergen, and Martin Rem. 4. Categorical concepts for programming languages: Robin Cockett, Barry Jay, and Andy Pitts.

A word of warning concerning the aims of this volume is in order. Other­ wise some readers might be unpleasantly surprised by the fact that two of the chapters of an ostensibly historical book are largely topical rather than historical. They are Chapters 7 and 9, respectively entitled 'Are Logical Truths Analytic?' and 'A Priori Truths and Things-In-Them­ selves'. Moreover, the history dealt with in Chapter 11 is so recent as to have more critical than antiquarian interest. This mixture of materials may seem all the more surprising as I shall myself criticize (in Chapter I) too facile assimilations of earlier thinkers' concepts and problems to later ones. There is no inconsistency here, it seems to me. The aims of the present volume are historical, and for that very purpose, for the purpose of understanding and evaluating earlier thinkers it is vital to know the conceptual landscape in which they were moving. A crude analogy may be helpful here. No military historian can afford to neglect the topo­ graphy of the battles he is studying. If he does not know in some detail what kind of pass Thermopylae is or on what sort of ridge the battle of Bussaco was fought, he has no business of discussing these battles, even if this topographical information alone does not yet amount to historical knowledge.

Law, Ideology and Punishment: Retrieval and Critique of the Liberal Ideal of Criminal Justice (Law and Philosophy Library #12)

This book is about 'Kantianism' in both a narrow and a broad sense. In the former, it is about the tracing of the development of the retributive philosophy of punishment into and beyond its classical phase in the work of a number of philosophers, one of the most prominent of whom is Kant. In the latter, it is an exploration of the many instantiations of the 'Kantian' ideas of individual guilt, responsibility and justice within the substantive criminal law . On their face, such discussions may owe more or less explicitly to Kant, but, in their basic intellectual structure, they share a recognisably common commitment to certain ideas emerging from the liberal Enlightenment and embodied within a theory of criminal justice and punishment which is in this broader sense 'Kantian'. The work has its roots in the emergence in the 1970s and early 1980s in the United States and Britain of the 'justice model' of penal reform, a development that was as interesting in terms of the sociology of philosophical knowledge as it was in its own right. Only a few years earlier, I had been taught in undergraduate criminology (which appeared at the time to be the only discipline to have anything interesting to say about crime and punishment) that 'classical criminology' (that is, Beccaria and the other Enlightenment reformers, who had been colonised as a 'school' within criminology) had died a major death in the 19th century, from which there was no hope of resuscitation.

It gives me great pleasure to offer this foreword to the present work of my admired friend and respected colleague Ota Weinberger. Apart from the essays of his which were published in our joint work An Institutional Theory of Law: New Approaches to Legal Positivism in 1986, relatively little of Wein­ berger's work is available in English. This is the more to be regretted, since his is work of particular interest to jurists of the English-speaking world both in view of its origins and in respect of its content As to its origins, Weinberger war reared as a student of the Pure Theory of Law, a theory which in its Kelsenian form has aroused very great interest and has had considerable influence among anglophoone scholars -perhaps even more than in the Germanic countries. Less well known is the fact that the Pure Theory itself divided into two schools, that of Vienna and that of Brno. It was in the Brno school of Frantisek Weyr that Weinberger's legal theory found its early formation, and perhaps from that early influence one can trace his continuing insistence on the dual character of legal norms -both as genuinely normative and yet at the same time having real social existence.
