Conditions of Rational Inquiry: A Study in the Philosophy of Value (Bloomsbury Academic Collections: Philosophy)

by David Pole

D. Pole, whose Later Philosophy of Wittgenstein appeared in 1958, here makes a new attack on the problem of value-judgement by taking it out of its limited ethical context. Beginning with an examination and criticism of current views that base all moral and other principles on personal choice or decision, he finds a point of departure for his own account of the problem in the claim that rational inquiry of any sort rests on the possibility of evaluation. The place of the one process within the other is then worked out in some detail; and an attempt is made to show how inquiry, as a collective undertaking, involves the progressive search for and establishment of new principles.

Conference Terminology: In English, French, Spanish, Russian, Italian, German and Hungarian (Glossaria Interpretum)

by J. Herbert

Analysis of the great demand for this work over a number of years has revealed that conference participants and interpreters, for whom the manual was primarily intended, are by no means alone in appreciating the usefulness and reliability of this unique publication. Whilst the editor has taken account of a small number of linguistic refinements and preferences in recent conference usage and has carefully reviewed the original material, he has seen no reason to enlarge the scope or alter the format of the previous edition - both these features of an essentially concise handbook having clearly met the practical requirements of its many users. For this edition the number of languages has been increased to include Hungarian.

The Confluence of Philosophy and Law in Applied Ethics

by Norbert Paulo

The law serves a function that is not often taken seriously enough by ethicists, namely practicability. A consequence of practicability is that law requires elaborated and explicit methodologies that determine how to do things with norms. This consequence forms the core idea behind this book, which employs methods from legal theory to inform and examine debates on methodology in applied ethics, particularly bioethics. It is argued that almost all legal methods have counterparts in applied ethics, which indicates that much can be gained from comparative study of the two. The author first outlines methods as used in legal theory, focusing on deductive reasoning with statutes as well as analogical reasoning with precedent cases. He then examines three representative kinds of contemporary ethical theories, Beauchamp and Childress’s principlism, Jonsen and Toulmin’s casuistry, and two versions of consequentialism—Singer’s preference utilitarianism and Hooker’s rule-consequentialism—with regards to their methods. These examinations lead to the Morisprudence Model for methods in applied ethics.

A Confucian Analysis on the Evolution of Chinese Patent Law System

by Nan Zhang

This book comprehensively discusses the main features of the Chinese patent law system, which not only legally ‘transplants’ international treaties into the Chinese context, but also maintains China’s legal culture and promotes domestic economic growth. This is the basis for encouraging creativity and improving patent law protection in China. The book approaches the evolution of the Chinese patent system through the ancient Chinese philosopher Confucius’s classic principle, offering readers a fresh new way to understand and analyze Chinese patent law reforms, while also outlining how Confucian insights could be used to improve the enforcement of patent law and overall intellectual property protection awareness in China. It examines ancient Chinese innovation history, explores intellectual property from a Confucian perspective, and discusses the roots of Chinese patent law, as well as the past three amendments and the trends in the ongoing fourth amendment. In addition to helping readers grasp the mentality behind the Chinese approach to patent law and patent protection, the book provides an alternative research methodology and philosophical approach by demonstrating Confucian analysis, which provides a more dynamic way to justify intellectual property in the academic world. Lastly, it suggests future strategies for local industries in the legal, cultural and sociological sectors in China, which provide benefits for domestic and overseas patent holders alike. The book offers a valuable asset for graduate students and researchers on China and intellectual property law, as well as general readers interested in Asian culture and the philosophy of law.
