Modern states claim rights of jurisdiction and control over particular geographical areas and their associated natural resources. Boundaries of Authority explores the possible moral bases for such territorial claims by states, in the process arguing that many of these territorial claims in fact lack any moral justification. The book maintains throughout that the requirement of states' justified authority over persons has normative priority over, and as a result severely restricts, the kinds of territorial rights that states can justifiably claim, and it argues that the mere effective administration of justice within a geographical area is insufficient to ground moral authority over residents of that area. The book argues that only a theory of territorial rights that takes seriously the morality of the actual history of states' acquisitions of power over land and the land's residents can adequately explain the nature and extent of states' moral rights over particular territories. Part I of the book examines the interconnections between states' claimed rights of authority over particular sets of subject persons and states' claimed authority to control particular territories. It contains an extended critique of the dominant "Kantian functionalist" approach to such issues. Part II organizes, explains, and criticizes the full range of extant theories of states' territorial rights, arguing that a little-appreciated Lockean approach to territorial rights is in fact far better able to meet the principal desiderata for such theories. Where the first two parts of the book concern primarily states' claims to jurisdiction over territories, Part III of the book looks closely at the more property-like territorial rights that states claim - in particular, their claimed rights to control over the natural resources on and beneath their territories and their claimed rights to control and restrict movement across (including immigration over) their territorial borders.

In fact, as Jennifer Pitts shows, international law was forged at least as much through Europeans’ domineering relations with non-European states and empires, leaving a legacy still visible in the unequal structures of today’s international order. Pitts focuses on the eighteenth and nineteenth centuries, the great age of imperial expansion, as European intellectuals and administrators worked to establish and justify laws to govern emerging relationships with non-Europeans. Relying on military and commercial dominance, European powers dictated their own terms on the basis of their own norms and interests. But ordinary diplomats, colonial administrators, and journalists played their part too, as did some of the greatest political thinkers of the time, among them Montesquieu and John Stuart Mill. Against this growing consensus, however, dissident voices as prominent as Edmund Burke insisted that European states had extensive legal obligations abroad that ought not to be ignored. These critics, Pitts shows, provide valuable resources for scrutiny of the political, economic, and legal inequalities that continue to afflict global affairs.

The Boundary Stones of Thought: An Essay in the Philosophy of Logic

The Boundary Stones of Thought seeks to defend classical logic from a number of attacks of a broadly anti-realist character. Ian Rumfitt is sympathetic to many of the premisses underlying these attacks. Indeed, he regards some of them as effective challenges to certain principles of classical semantics, notably the Principle of Bivalence. He argues, though, that they are ineffective against classical logic itself. The book starts by considering the general problem of how conflicts over logical laws may be rationally discussed and adjudicated. This leads to a consideration of the nature of logic: Rumfitt identifies the particular features that mark out logical consequence from other consequence relations, and he advances a new argument for the ancient thesis that there is a modal element in the notion of logical consequence. He develops a theory of that modal element in terms of perhaps incomplete possibilities, rather than fully determinate possible worlds. Some prima facie powerful arguments against the validity of certain classical logical laws are then analysed in the light of this account of logic. Throughout, care is taken to separate lines of anti-classical argument that, although distinct, are often run together or confused. The analysis yields, as by-products, semantic theories for a number of problematical areas of discourse. These areas include our talk about sub-atomic particles, about the infinite, about infinitesimals, about sets, and vague discourse. Rumfitt concludes by defending his stance of accepting classical logic while rejecting Bivalence, against Aristotle's argument that a classical logician is committed to Bivalence. The ultimate aim is to liberate classical logic from the dead hand of classical semantics.

Its main challenger, liberalism, looks to Kant and nineteenth-century economists. The Bounds of Agency: An Essay in Revisionary Metaphysics

The subject of personal identity is one of the most central and most contested and exciting in philosophy. Ever since Locke, psychological and bodily criteria have vied with one another in conflicting accounts of personal identity. Carol Rovane argues that, as things stand, the debate is unresolvable since both sides hold coherent positions that our common sense will embrace. Our very common sense, she maintains, is conflicted; so any resolution to the debate is bound to be revisionary. She boldly offers such a revisionary theory of personal identity by first inquiring into the nature of persons.Rovane begins with a premise about the distinctive ethical nature of persons to which all substantive ethical doctrines, ranging from Kantian to egoist, can subscribe. From this starting point, she derives two startling metaphysical possibilities: there could be group persons composed of many human beings and multiple persons within a single human being. Her conclusion supports Locke's distinction between persons and human beings, but on altogether new grounds. These grounds lie in her radically normative analysis of the condition of personal identity, as the condition in which a certain normative commitment arises, namely, the commitment to achieve overall rational unity within a rational point of view. It is by virtue of this normative commitment that individual agents can engage one another specifically as persons, and possess the distinctive ethical status of persons.

He endorses a revisionist approach to just war theory and argues in its defense; and he also shows how his evidence-relative account supports revisionist just war theory by better grounding it in the real world of modern warfare. Lastly, he offers a new proposal for how targeting in war could better align with respect for the rights of individual persons, and demonstrate how revisionist just war theory-and any rights-respecting just war account more broadly-could conceivably work in practical ways.
