In support of this thesis the book examines, generally, the question of what it is to have knowledge of law; and this examination embraces not just the conceptual foundations, methods, taxonomy and theories used by jurists. It also examines the epistemological schemes used by social scientists in general in order to show that such schemes are closely related to the schemes of intelligibility used by lawyers and judges.

This book documents the process of transformation from natural philosophy, which was considered the most important of the sciences until the early modern era, into modern disciplines such as mathematics, physics, natural history, chemistry, medicine and engineering. It focuses on the 18th century, which has often been considered uninteresting for the history of science, representing the transition from the age of genius and the birth of modern science (the 17th century) to the age of prodigious development in the 19th century. Yet the 18th century, the century of Enlightenment, as will be demonstrated here, was in fact characterized by substantial ferment and novelty. To make the text more accessible, little emphasis has been placed on the precise genesis of the various concepts and methods developed in scientific enterprises, except when doing so was necessary to make them clear. For the sake of simplicity, in several situations reference is made to the authors who are famous today, such as Newton, the Bernoullis, Euler, d’Alembert, Lagrange, Lambert, Volta et al. – not necessarily because they were the most creative and original minds, but mainly because their writings represent a synthesis of contemporary and past studies. The above names should, therefore, be considered more labels of a period than references to real historical characters.

According to his later (sometime around 1953) remark, a lesser known or commented upon but arguably more important one: ‘‘That the Lord should play [dice], all right; but that He should gamble according to definite rules [i. e. , according to the rules of quantum mechanics, rather than 2 by merely throwing dice], that is beyond me. ’’ Although Einstein’s invocation of God is taken literally sometimes, he was not talking about God but about the way nature works. Years ago, prompted by Grize, Apostel and Papert, we undertook the study of functions, but until now we did not properly understand the relations between functions and operations, and their increasing interactions at the level of 'constituted functions'. By contrast, certain recent studies on 'constitutive functions', or preoperatory functional schemes, have convinced us of the existence of a sort of logic of functions (springing from the schemes of actions) which is prior to the logic of operations (drawn from the general and reversible coordinations between actions). This preoperatory 'logic' accounts for the very general, and until now unexplained, primacy of order relations between 4 and 7 years of age, which is natural since functions are ordered dependences and result from oriented 'applications'. And while this 'logic' ends up in a positive manner in formalizable structures, it has gaps or limitations. Psychologically, we are interested in understanding the system­ atic errors due to this primacy of order, such ·as the undifferentiation of 'longer' and 'farther', or the non-conservations caused by ordinal estimations (of levels, etc. ), as opposed to extensive or metric evaluations. In a sense which is psychologically very real, this preoperatory logic of constitutive functions represents only the first half of operatory logic, if this can be said, and it is reversibility which allows the construction of the other half by completing the initial one-way structures.

Even today, many epistemologists, including contextualists and subject-sensitive invariantists are concerned with the truth conditions of "S knows that p," or the proposition it expresses. In all of this literature, the method of cases is used, where a situation is described in English, and then philosophers judge whether it is true that S knows that p, or whether saying "S knows that p" is false, deviant, etc. in that situation. However, English is just one of over 6000 languages spoken around the world, and is the native language of less than 6% of the world's population. When Western epistemology first emerged, in ancient Greece, English did not even exist. So why should we think that facts about the English word "know," the concept it expresses, or subtle semantic properties of "S knows that p" have important implications for epistemology? Are the properties of the English word "know" and the English sentence 'S knows that p' shared by their translations in most or all languages? If that turned out to be true, it would be a remarkable fact that cries out for an explanation. But if it turned out to be false, what are the implications for epistemology? Should epistemologists study knowledge attributions in languages other than English with the same diligence they have shown for the study of English knowledge attributions? If not, why not? In what ways do the concepts expressed by 'know' and its counterparts in different languages differ? And what should epistemologists make of all this? The papers collected here discuss these questions and related issues, and aim to contribute to this important topic and epistemology in general.

Due to the unprecedented interest which the announcement of the topic of epistemology evoked from contributors, two annual volumes will be devoted to it. This volume accordingly is entitled Epistemology I, and the next volume will be entitled Epistemology II. The Editor KNOWING IN THE STRONG SENSE PETER M. BURKHOLDER Professor Norman Malcolm has defended what he calls "the strong sense" of "know." 1 It is one of the propositional senses; i.e. what is said to be known, in this sense, is an item of information rather than a person, a poem, a physical object, or a skill. According to· Malcolm, this sense of "know" is important and useful.' Philosophers have had it "in mind when they have spoken of 'perfect,' 'metaphysical,' or 'strict' cer­ tainty" (Ke, 70). Moreover, laymen use it when they profess to know such obvious truths as "2 + 2 = 4" or "This is an ink-bottle" (said while peering at and poking an ink-bottle). Nevertheless, in spite of his opinion that it is important, Malcolm has not given a detailed analysis of the strong sense of "know." Thus we may be justified in studying it, first to determine exactly what it is, and then to evaluate it. I do not, of course, wish to suggest that Malcolm necessarily WQuid accept my account of the strong sense as an accurate expli­ cation of his opinions. However, in its descriptive aspects my analysis seems compatible with his written statements.

In­ deed, he is as admired for his brilliance, intellectual flexibility, and crea­ tivity as he is for his warmth, kindness, and integrity, and does not the presence of so many wonderful qualities in one human being assume the dimensions of an impossibility? But Peter Hempel is not only possible but actual! One of us (Hilary Putnam) remembers vividly the occasion on which he first witnessed Hempel 'in action'. It was 1950, and Quine had begun to attack the analytic/synthetic distinction (a distinction which Carnap and Reichenbach had made a cornerstone, if not the keystone, of Logical Em­ piricist philosophy). Hempel, who is as quick to accept any idea that seems to contain real substance and insight as he is to demolish ideas that are empty or confused, was one of the first leading philosophers outside of Quine's immediate circle to join Quine in his attack. Hempel had come to Los Angeles (where Reichenbach taught) on a visit, and a small group consisting of Reichenbach and a few of his graduate students were gath­ ered together in Reichenbach's home to hear Hempel defend the new posi­ tion.

The last decades have seen major reformations in the philosophy and history of science. What has been called 'post-positivist' philosophy of science has introduced radically new concerns with historical, social, and valuative components of scientific thought in the natural sciences, and has raised up the demons of relativism, subjectivism and sociologism to haunt the once­ calm precincts of objectivity and realism. Though these disturbances intruded upon what had seemed to be the logically well-ordered domain of the philoso­ phy of the natural sciences, they were no news to the social sciences. There, the messy business of human action, volition, decision, the considerations of practical purposes and social values, the role of ideology and the problem of rationality, had long conspired to defeat logical-reconstructionist programs. The attempt to tarne the social sciences to the harness of a strict hypothetico­ deductive model of explanation failed. Within the social sciences, phenome­ nological, Marxist, hermeneuticist, action-theoretical approaches vied in attempting to capture the distinctiveness of human phenomena. In fact, the philosophy of the natural sciences, even in its 'hard' forms, has itself become infected with the increasing reflection upon the role of such social-scientific categories, in the attempt to understand the nature of the scientific enterprise.

This must be done because epistemology has been pronounced dead, and methodology nonexisting; and because, when acknowledged at all, they are often misplaced. 1. DESCRIPTIVE EPISTEMOLOGY The following problems are typical of classical epistemology: (i) What can we know? (ii) How do we know? (iii) What, if anything, does the subject contribute to his knowledge? (iv) What is truth? (v) How can we recognize truth? (vi) What is probable knowledge as opposed to certain knowledge? (vii) Is there a priori knowledge, and if so of what? (viii) How are knowledge and action related? (ix) How are knowledge and language related? (x) What is the status of concepts and propositions? In some guise or other all of these problems are still with us. To be sure, if construed as a demand for an inventory of knowledge the first problem is not a philosophical one any more than the question 'What is there?'. But it is a genuine philosophical problem if construed thus: 'What kinds of object are knowable-and which ones are not?' However, it is doubtful that philosophy can offer a correct answer to this problem without the help of science and technology. For example, only these disciplines can tell us whether man can know not only phenomena (appearances) but also noumena (things in themselves or self-existing objects).
