A History of War Crimes Trials in Post 1945 Asia-Pacific

Postcolonial Citizenship in Provincial Indonesia

This book examines the history of state formation in postcolonial Indonesia by starting with the death of Jan Djong, an activist and a former village head in the little town of Maumere. It historicizes contemporary debates on citizenship in the postcolonial world.Citizenship has been called the “organizing principle of state-society relations in modern states”. Democratization is today most intense in the non-Western, post-colonial world. Yet “real” citizenship seems largely absent there. Only a few rights-claiming, autonomous, and individualistic citizens celebrated in mainstream literature exist in post-colonial countries.In reflecting on one concrete story to examine the core dilemmas facing the study of citizenship in postcolonial settings, this book challenges ethnocentricity found within current scholarly work on citizenship in Europe and North America and addresses issues of institutional fragility, political violence, as well as legitimacy and aspirations to freedom in non-Western cultures.

Axial Shift: City Subsidiarity and the World System in the 21st Century

This book uses historical analysis, constitutional economics, and complexity theory to furnish an account of city subsidiarity as a legal, ethical, political, and economic principle. The book contemplates subsidiarity as a constitutional principle, where cities would benefit from much wider local autonomy. Constitutional economics suggests an optimal limit to jurisdictional footprints (territories). This entails preference for political orders where sovereignty is shared between different cities rather states where capital cities dominate. The introduction of city subsidiarity as a constitutional principle holds the key to economic prosperity in a globalizing world. Moreover, insights from complexity theory suggest subsidiarity is the only effective response to the ‘problem of scale.’ It is a fitness trait that prevents highly complex systems from collapsing. The nation-state is a highly complex system within which cities function as ‘attractors.’ The collapse of such systems would ensue if there were strong coupling between attractors. Such coupling obtains under legal monism. Only subsidiarity can make the eventuality of collapse improbable. The emergent and self-organizing properties of subsidiarity entail a shift in policy emphasis towards cities with a wide margin of autonomy.

Politics, Managerialism, and University Governance: Lessons from Hong Kong under China’s Rule since 1997 (Governance and Citizenship in Asia)

Since the mid-20th century, literature on the state, market, and higher education has focused on the state’s shifting role from the direct administration to the supervision of higher education, and its increased use of market and managerial principles and techniques to regulate public universities. However, very few studies have addressed the political influences on university governance produced by changing state-university-market relationships, the chancellorship of public universities, or students’ and academics’ civic engagement with regard to sensitive political issues. The book examines both the positive and problematic outcomes of using market principles and managerialism to reform public higher education; questions the longstanding tradition of university chancellorship; explores the issue of external members holding the majority on university governing boards; probes into the dilemma of either relying on the system or a good chancellor and external members to preserve universities’ autonomy and academic freedom; and assesses the cost of students’ and academics’ civic engagement with regard to politically sensitive issues.
