Regulating and Combating Money Laundering and Terrorist Financing: The Law in Emerging Economies (The Law of Financial Crime)

This book analytically reviews the impact of the global anti-money laundering and counter-terrorist financing (AML/CFT) framework on the compliance trajectory of a number of jurisdictions to this framework. The work begins by examining the international financial sector reform and its evolution to inculcate the global framework for AML/CFT regulations. It challenges the resulting uniform AML/CFT due to its paradoxical impact on the compliance trajectory of African countries and emerging economies (ACs/EEs). This is done through an examination of the pre-conditions for effective regulation and compliance drivers for ACs/EEs that reveals the behavioural impact of the AML/CFT standards on the bloc of countries. Through the application of agency theory, it explores the relationship between ACs/EEs on the one hand and the international financial institutions that formulate, disseminate and facilitate compliance with the global framework for AML/CFT standards on the other. The remaining chapters review empirically the compliance pressures and resulting compliance trajectory of ACs/EEs with the AML/CFT standards. The final part of the book provides a detailed explanation of the compliance challenges of ACs/EEs and the legitimacy concerns that facilitate this. This book offers a new direction on the impact of global AML/CFT standards on ACs/EEs and contributes to the understanding of the conditions under which the global standards are likely to facilitate proactive compliance within these blocs of countries. As such it will be a valuable resource for academics, researchers and policy-makers working in this area.

Assessment of Energy-Efficient Building Details for Seismic Regions (Springer Tracts in Civil Engineering)

This open access book presents a methodology for the assessment of structural building details, taking into account the contemporary guidelines for earthquake-resistant and energy-efficient buildings. A review of structural details for energy-efficient buildings revealed that in some cases the structural system is interrupted, leading to solutions which are not suitable for earthquake-prone regions. Such typical examples would be the use of thermal insulation under the building foundation and reduction of the load-bearing elements’ dimensions – also at the potential locations of plastic hinges which are crucial for the dissipation of seismic energy. The proposed methodology of assessment favours a collaboration of architects, engineers, contractors and investors in the early stage of building design. By this the methodology enables efficient decision-making and contributes to a selection of optimal building structural details.The book starts by presenting the typical structural details of the thermal envelope of energy-efficient buildings together with the scientific background required for understanding the process of detail development from all the relevant aspects. The Impact of European Rights on National Legal Cultures (Modern Studies in European Law)

This book contributes to the debate about the impact of European Community Law on the national constitutional orders and cultures of the respective Member States. The author examines the doctrine of sovereignty as a mechanism within which this impact may be best assessed and in particular how it underwrites the tension between European Union rights and the rights provided by the respective legal orders of the Member States. In particular the book focuses on political,social and civil rights, drawing from T.H. Marshall's typology. In endorsing an appropriate analytical framework, the book challenges both existing law and secondary literature in order to argue that the terminology, the concepts and the tools which are used to assess the impact of the EC law on the national constitutional orders are to be selected with great care. Japan’s Colonialism and Indonesia

The rise and fall of the Japanese empire constitutes one of the most dramatic episodes of modern history. Within the short span of fifty years Japan grew out of political backwardness into a position of tremendous power. Japan's rise to power challenged Europe's hegemony over Asia, but, paradoxically, it was Japan's fall that caused the irreparable ruin of the colonial system over Eastern lands. Japan went to war against the West under the battlecry of Asia's liberation from European colonialism. In reality, for forty years, beginning with her first war against China, she had striven to imitate this colonialism, as she had endeavoured to imitate the political, military and economic achievements of Europe. A thorough understanding of the imitative character of the Japanese Empire might well have induced the leaders of the nation to side with the conservative trend of political thought in the Western world in order to maintain the existing world-wide political system of which colonial rule was an accepted part. They might have understood that an adventurous, revolutionary policy was bound to result in grave dangers for their own state and most conservative structure. Japan might have continued to grow and to expand if she had succeeded to play the role of the legitimate heir to Europe's decaying power in Asia. By violently opposing that power, she undermined the very foun­ dations of her own rule outside the home-islands.

Religion and Mysticism in Early Islam: Theology and Sufism in Yemen (Library of Middle East History)

Research involving the chemical physics of the inert or rare gases continues unabated. This small volume is meant to deal with advances that have occurred in three selected areas over the past decade. It forms a natural outgrowth of earlier reviews and volumes that have dealt almost exclusively with pure rare-gas solids. Originally, a single chapter was envisaged to cover the topic of alloys and impurities in solid rare gases. However, over the past ten years this single chapter spawned many offshoots and eventually the project became too large for a single volume. Thus the present book contains only a small subset of possbile topics involving rare-gas solids intentionally doped with impurities. Chapter 1 gives a brief overview of current research devoted to the rare gases. This is followed by a comprehensive, self-contained chapter dealing with the most recent developments in the area of interatomic inter­ actions. Chapter 3 is concerned with the lattice dynamics of rare-gas solids doped with an impurity which is either another rare-gas or a small molecule. The final chapter deals with the spectroscopy of vibrating and rotating di­ atomic impurities in rare-gas solids. The birth of this volume was not without its labour pains. I should like to take this opportunity to thank the various people who have at one time or another been involved throughout its gestation period. Clearly, many important topics are omitted from this volume.
