Quasi-Constitutionality and Constitutional Statutes: Forms, Functions, Applications (Comparative Constitutional Change)


This book examines the interstices among statutory enactment, constitutional convention and formal constitution in which quasi-constitutionality exists. It provides a focal resource that can serve as a point of reference for scholars interested in quasi-constitutionality as a whole, from national and transnational perspectives, expanding on its many forms, functions, and applications with recourse to comparative insights. The book is divided in three main Parts, each of them preceded by a separate critical introduction in which an informed scholar contextualizes the chapters and offers reflections on the themes they develop. The first Part, titled 'Forms', is composed of chapters that address, from a theoretical and comparative perspective, questions related to the recognition of constitutional statutes and quasi-constitutional legislation. The second Part is titled 'Functions', and contains chapters that explore the explanatory power of quasi-constitutionality in different institutional contexts. The third Part, titled 'Applications', considers the ways in which constitutional statutes and quasi-constitutionality operate in relation to particular tensions and debates present in various jurisdictions.

This book explores accountability from a range of perspectives, crossing traditional disciplinary, thematic, and professional boundaries. It asks fresh questions about accountability and its place and importance in democratic societies. Accountability matters. It matters because it connects the governors with the governed, and for this reason it is a hallmark of democratic governance. And yet, amidst a backdrop of concerns about democratic back-sliding, the rise of populism, the role of algorithmic governance, moral barbarism, and post-truth politics - to mention just a few issues - a number of potentially far-reaching questions of accountability have been asked. It is for exactly this reason that this book explores the concept of accountability from a range of perspectives, crossing traditional disciplinary, thematic, and professional boundaries. Migrant workers around the world are subject to exploitative labor practices that give employers extraordinary bargaining power. This book brings together researchers, practitioners, and advocates who explore the many ways that contracted migrant workers are rendered vulnerable in the workplace. In this book, the term ‘21st-century coolie’ is deployed as a heuristic device that foregrounds the deeply unequal structures shaping the transnational flows of short-term, migrant workers. The term ‘coolie’ harkens back to the labor arrangements of earlier centuries that involved conscripted labor, indentured servitude, and contract labor across national borders. Mit dem gerechten Frieden geht - gerade wie er in der Friedensdenkschrift der Evangelischen Kirche in Deutschland niedergelegt ist - für viele seiner Vertreterinnen und Vertreter eine Absage an die Lehre vom gerechten Krieg einher. Friedensordnung wird als Rechtsordnung begriffen. Mit diesem rechtsethischen Verständnis verbindet sich aber kein radikaler Pazifismus. Vielmehr bleibt Frieden auf die Durchsetzung des Rechts – und dafür steht der Terminus der rechtserhaltenden Gewalt – verwiesen. Ihre ethischen Kriterien werden dann aber wieder im Rückgriff auf den gerechten Krieg generiert. Diese Parallelität ist nicht unproblematisch. In einen anderen Rahmen gestellt gilt es, grundlegend über die Begründung und Verortung der rechtserhaltenden Gewalt neu nachzudenken.

Mit der Festschrift zu Ehren Hermann Eichlers iibernimmt die Rechtswissenschaftliche Fakultat der Johannes Kepler Universitat in Linz die Pflege einer altbewahrten Tradition der Wiirdigung ver­ dienter Rechtslehrer. DaB alle damit verbundenen Anfangsschwie­ rigkeiten bewaltigt werden konnten, ist nicht zuletzt der besonderen Wertschatzung des Jubilars zu danken. Dennoch mochte ich es nicht versaumen, die Verdienste aller jener hervorzuheben, die zum Ge­ ling en des Werkes beigetragen haben. Mein Dank gilt im beson­ deren Herrn o. Univ. Fragen der Rechtsgestaltung, nach geeigneten und in der Sache passenden rechtlichen Handlungs-und Organisations­ formen oder nach gegenstandsadäquaten Regelungstechniken werden von der Rechtswissenschaft in Österreich nur am Ran­ de aufgegriffen. Dieser Befund kontrastiert in auffälliger Weisc mit dem Umstand, daß viele Juristen in rechtsgestaltenden Funktionen tätig und dort tagtäglich mit dem Problem kon­ frontiert sind, in unterschiedlichsten Sachbereichen für die Umsetzung politischer Regelungsziele die sachadäquaten recht­ lichen Umsetzungsmechanismen und -instrumente finden zu müssen. Sie werden dabei von der Rechtswissenschaft, sowohl was ihre Ausbildung, als auch was die wissenschaftliche Unter­ stützung durch Aufzeigen von Möglichkeiten und Alternativen anlangt, allein gelassen. Dies verwundert um so mehr, als der Or­ Innovationsbedarf im Bereich rechtlicher Handlungs-und ganisationsformen und die Notwendigkeit neuer Regelungs­ zugänge allenthalben betont wird. Die praktisch tätigen Legisten können das Problem allein kaum bewältigen. Gesetzesvorhaben stehen weitgehend un­ ter dem Diktat tagespolitischer Bedürfnisse. Probleme wer­ den anlaßfallbezogen und punktuell gelöst. Der Gesetzgeber läuft oft gesellschaftlichen Entwicklungen hinterher und ist bloß bemüht, allzu unliebsamen Auswirkungen punktuell gegenzusteuern. Damit bekämpft er Symptome, wo Regulie­ rung von Ursachen notwendig wäre. Kongruenz und Geschlos­ senheit rechtlicher Teilsysteme gehen verloren bzw lösen sich auf. Hinter einer Flut von Einzelfallbestimmungen läßt sich nur mehr mit Mühe die Fiktion eines Regelungszusammen­ hangs aufrechterhalten. This collection offers a study of the regimes for the recognition and enforcement of foreign commercial judgments in 15 Asian jurisdictions: mainland China, Hong Kong, Taiwan, Japan, Korea, Malaysia, Singapore, Thailand, Vietnam, Cambodia, Myanmar, the Philippines, Indonesia, Sri Lanka and India. For practising lawyers, the book is intended as a practical guide to current law and procedures for enforcing judgments in the selected jurisdictions. However, it does not stop at describing current law and practice. Of interest to academics and students, it also analyses the common principles of the enforcement regimes across the jurisdictions, and identifies what should be regarded as the norm for enforcement in Asian countries for the purpose of attracting foreign direct investment and catalysing rapid economic development. In light of the common principles identified, the book explores how laws in Asia may generally be improved to enable judgments to be more readily enforced, while ensuring that legitimate concerns over indirect jurisdiction, due process and domestic public policy are respected and addressed. With this in mind, the book discusses the potential impact that the adoption of the 2005 Hague Convention on Choice of Court Agreements might have on Asian jurisdictions; it also considers the potential impact of the convention for the enforcement of judgments in civil and commercial matters presently being drafted by the Hague Conference on Private International Law.This timely book argues that it is imperative to adopt a uniform system for the recognition and enforcement of judgments throughout Asia if there is to be traction for the enhanced cross-border commerce that is expected to result from endeavours such as the ASEAN Economic Community (AEC), the Belt and Road Initiative (BRI), CPTPP (also known as TPP-11), and RCEP.
